In recognition of the national emergency declared by the President of the United States in response to the outbreak of COVID-19, the Trust has determined that in order to provide for the continuity of operations and to fulfill the primary purpose of the Trust to pay the Trust’s claimants, the Trust is offering two additional temporary methods for claimants to execute a Release and Discharge agreement (“Release”).

    1.         Electronic Signature Option.  After Counsel to Trust claimants approve the value of a claim and the form of Release for a claimant, he or she can request that the Release be signed by electronic means (“Electronic Signature Option”).  To implement the Electronic Signature Option, the Trust offers the following procedure:

            a.         Counsel to Trust claimants who intend to use the Electronic Signature Option are required to execute a Consent to Contact Client and Waiver (“Consent and Waiver”) and the related Option for Signing Consent to Contact Client and Waiver by Electronic Means (“Electronic Option Agreement”), both of which are attached as Exhibit A.  The Consent and Waiver authorizes the Trust to contact claimants represented by counsel by telephone or otherwise to authenticate that the claimant affixed or affirmed their electronic signature on a Release and on the Electronic Signature Agreement described below.  Counsel to Trust claimants who wish to electronically sign the Consent and Waiver must use the fill and sign Adobe feature designated by the Trust, or a commercially available equivalent which produces an electronic signature in .pdf format, to electronically sign both the Consent and Waiver and the Electronic Option Agreement.  Both executed documents must then be submitted to the Trust via email to support@524gtrust.com using the language set forth in Exhibit B.  The Consent and Waiver may also be executed manually and returned to the Trust via overnight courier.  The Consent and Waiver must be properly executed and returned to the Trust before a law firm representing Trust claimants may select the Electronic Signature Option or the Direct Mail Option set forth below. 

            b.         After the Trust has accepted the Consent and Waiver, if counsel for a Trust claimant intends to use the Electronic Signature Option, counsel will electronically send the claimant the approved Release and an Agreement to Allow Electronic Signatures, attached as Exhibit C (“Electronic Signature Agreement”).  The Electronic Signature Agreement authorizes the claimant to sign both the Electronic Signature Agreement and the Release electronically.   The electronic signature can be affixed to both documents using the fill and sign Adobe feature designated by the Trust, or a commercially available equivalent which produces an electronic signature in .pdf format, as directed by counsel for the Trust claimant.  After affixing his or her electronic signature to the documents, claimant must return those documents to counsel.  Counsel to the Trust claimant will send the electronically signed documents to the Trust, indicate in writing that the Consent and Waiver is applicable and provide telephonic contact information for each claimant for which counsel intends to use the Electronic Signature Option, all via email to support@524gtrust.com.

            c.         In order to complete the Electronic Signature Option process, the Trust will attempt to contact a claimant by telephone using the contact information provided by the claimant’s counsel.  The claimant must provide the Trust with sufficient unique and personal information which, in the Trust’s sole discretion, satisfies the Trust that the person contacted is the claimant who intended to affix or affirm their electronic signature on the Release and the Electronic Signature Agreement.  If the claimant’s electronic signature cannot be authenticated by the Trust (e.g., the Trust is unable to reach the claimant by telephone, or insufficient correct identifying information is provided by the person contacted) then the electronic signature will not be accepted by the Trust and the Electronic Signature Option may not be utilized for that claimant. 

            d.         Counsel and Trust claimants may continue to use the existing manual execution method for executing Releases, or the Direct Mail Option set forth below, in addition to the Electronic Signature Option.

    2.         Direct Mail Option.  If counsel to a Trust claimant has an approved Consent and Waiver on file with the Trust, and has confirmed in writing to the Trust that the particular claimant is subject to the executed Consent and Waiver and has provided the Claimant’s current mailing address to the Trust, all via email to support@524gtrust.com, then counsel may select the option to have the claimant receive the Release directly from the Trust and, after claimant has signed the Release, to return it directly to the Trust (“Direct Mail Option”).  Claimants who exercise the Direct Mail Option will receive the original Release by mail from the Trust.  The Trust will provide a return envelope for use by the claimant to return the Release to the Trust by mail. 

            These provisions are expected to apply until May 30, 2020, or such prior or subsequent date as is determined at the sole discretion of the Trust.  The Trust may revert to its prior policies at any time in its sole discretion.

In recognition of the national emergency declared by the President of the United States in response to the outbreak of COVID-19, the state of emergency in response to the outbreak of COVID-19 and the ordering of shelter in place for everyone in California by the Governor of California, and the state of emergency declared by the Governor of the State of Nevada, the Trust has determined that in order to provide for the continuity of operations and to fulfill the primary purpose of the Trust to pay the Trusts’ claimants, the Trust will follow the following temporary policy changes:

The Trust will accept electronic signatures on Certification(s) for Unpaid Claims - Claimed Exposure Post December 5, 1980 and Certification(s) for Unpaid Claims – Claimed Exposure Pre December 5, 1980 (“Medicare Certifications”) pursuant to the following procedure:

The Trustees of the four asbestos injury settlement trusts, headquartered in Reno, Nev., the Western Asbestos, J.T. Thorpe, Thorpe Insulation, and Plant Asbestos Settlement Trusts (Trusts), today announced the appointment of Steven L. Bray as their next Executive Director, effective in early 2020.

“We’re truly fortunate that Steve is joining the Trusts as he brings the right mix of professional experience and skills to the position and is deeply committed to the Trusts’ goal of treating all claimants equitably,” said Managing Trustee Jack Luikart.  “The Trustees believe he will provide effective and efficient management of the Trusts.”

Mr. Bray most recently served as Vice President, General Counsel and Secretary of Johnson Matthey Inc. where he was the chief legal officer overseeing all functions of the Americas legal department for the international, publicly traded manufacturer of specialty chemicals and lithium ion battery materials. Prior to that, he served in positions of increasing managerial and legal responsibility with Albemarle Corporation, BP and The Hartford.

“I look forward to contributing to the Trusts’ efforts as we continue to tirelessly serve our claimants with transparency, efficiency, fairness and respect,” Bray said. “I am delighted to be joining the Trusts and am privileged to be working with such a dedicated and talented team of professionals.”        

Mr. Bray is a 1989 Distinguished Graduate of the United States Military Academy at West Point. Following military service as a field artillery officer in the United States Army, he received a Juris Doctorate degree from the University of Pennsylvania Law School and a Master of Business Administration degree (Risk Management and Decision Processes) from The Wharton School at the University of Pennsylvania.

Laura Paul, currently Acting Executive Director of the Trusts, will return full time to her position as Claims Manager when Mr. Bray begins.

Mr. Bray, his wife, Ana Marie, and their three children will reside in Reno.

Additions to Sections 2.3 and 2.7 of the Trust Distribution Procedures were approved by the Trustees, with consent of the Futures Representative and Trust Advisory Committee, as follows:

 

2.3  Trust Application of the Funds Received Ratio.

To the extent that the designated legal representative of a claimant or heir (or the Trust in the case of in pro per claimants), following reasonable efforts, cannot locate a claimant or heir within one year from the approval of any additional payment pursuant to Section 4.2, the legal representatives shall return all funds, which must be held in client trust accounts, to the Trust which the Trust shall return to net claimant equity.  To the extent the Trust cannot locate a claimant or heir in pro per within one year from the approval of any additional payment pursuant to Section 4.2 following reasonable efforts, the entire additional payment shall also be returned to net claimant equity.

 

2.7 Fundamental Adjustments.

Notwithstanding the foregoing, during 2019, in the event that the Trustees determine that the allocation of the Maximum Annual Payment for Category A Claims (Malignancy) of 88% is greater than the amount required to pay the actual and reasonably anticipated Category A Claims in 2019, then the Trustees are authorized, with consent of the TAC and the Futures Representative, to allocate as much of the excess Category A funds as may be necessary to timely pay Category B Claims (Non-Malignancy) in 2019.  In determining the amount of reasonably anticipated Category A Claims for 2019, the Trustees shall consider all available information, including, but not limited to, (i) the amount forecast by the Trust’s estimation expert as the dollar amount necessary to pay 2019 Category A Claims pursuant to the TDP and the Trust’s regular procedures and/or (ii) the dollar amount calculated by the Trust as necessary to pay Category B Claims pursuant to the TDP and the Trust’s regular procedures based upon the claims submitted that the Trust anticipates will be ready for payment in 2019.

Following appeals by Michael J. Mandelbrot and the Mandelbrot Law Firm from a Stipulation placed on the record in open court on January 23, 2014 in Declaratory Relief Adversary Proceedings filed by the J.T. Thorpe Settlement Trust and the Thorpe Insulation Settlement Trust regarding the Trusts' conduct in investigating Michael J. Mandelbrot and the Mandelbrot Law Firm, and the Order Following Trial and related documents, the Bankruptcy Court again ruled in favor of the Trusts and reaffirmed its Order Following Trial, Findings of Fact and Conclusions of Law, and Judgment.  For additional information, please see the Supplemental Findings of Fact and Conclusions of Law Following Remand and Judgment Following Remand.  Mr. Mandelbrot initially filed appeals from these orders, but has since agreed to dismiss those appeals.  For additional information, please see the Joint Stipulation Dismissing Appeal and Order Granting Joint Stipulation Dismissing Appeal.  As a result, litigation concerning Michael J. Mandelbrot and the Mandelbrot Law Firm has now been fully and finally resolved.  The Trusts urge beneficiaries and potential claimants considering filing claims against the Trusts to carefully review these documents before retaining counsel.

Section 5.4(a)(2) of the Plant Trust Distribution Procedures originally provided that the Statutes of Limitation and Repose ("Limitations") for claims which arose before the May 20, 2009 filing of the Petition in Bankruptcy ("Petition Date") would be tolled through February 23, 2016.  In 2017, the Trustees, with the consent of the Trust Advisory Committee and the Futures Representative, further extended post-bankruptcy tolling of Limitations.

To avoid Limitations, claims for decedents who passed away:

     i) prior to the filing of the bankruptcy petition, and not otherwise barred as of the Petition Date, must be filed with the Trust on or before September 30, 2018;

     ii) between the Petition Date and September 30, 2017, and not currently in litigation in California, must be filed with the Trust on or before September 30, 2018.

Claims that do not fall into the above two categories will be subject to Trust Distribution Procedures Section 5.3 which states, "The statute of limitations and the choice of law determined applicable to claims against the Trust shall be determined by reference to the Tort System where a claim against the Debtor was pending on the filing date of the case (so long as Plant was subject to personal jurisdiction in that location), or where such a claim could have been timely filed as asserted by the claimant or Injured Person".

The Trust would like to remind firms regarding the policy on the length of time claims are allowed to remain in certain statuses.

The policy is as follows:

The Trust can deem a claim withdrawn after the claim has been placed on "Hold/Deferred", in "Reviewed Deficient" status, or in "Offer Made" status and remains in one of those statuses for six (6) months.  Upon request and for good cause, the Trust may extend this period for an additional six (6) months.  After the extended period, the Trust will deem the claim withdrawn.

In addition, claims that remain in an "Incomplete" status will be withdrawn after two weeks.

According to the Trust Distribution Procedures, the existing statute of limitations for the claim will not be affected by the withdrawal, only its place in the FIFO queue.  "A claimant can withdraw a Trust Claim at any time upon written notice to the Trust and file another claim subsequently without affecting the status of the claim for statute of limitations purposes, but any such claim filed after the withdrawal shall be given a place in the FIFO Processing Queue based on the date of such subsequent filing."  TDP Section 6.3.

Any claim that is withdrawn or rejected may be resubmitted, but a new $250 filing fee will be required.

The Trust mourns deeply the loss of its distinguished Futures Representative, retired U.S. Federal Judge Charles Renfrew, and extends its heartfelt sympathy to his family.  

 

Serving as the Futures Representative since creation of the Trust, Judge Renfrew worked tirelessly on behalf of all future claimants to ensure that the Trust’s goals were met. 

 

Trust rules make no provision for an interim Futures Representative and require that the Trustees act now to nominate a qualified individual to succeed Judge Renfrew. The U.S. Bankruptcy Court, Northern District of California (San Francisco Division) must confirm the nominee.

 

The nomination selection process is underway and the new Futures Representative will be announced and submitted to the Bankruptcy Court for its approval in the coming weeks.

At the December Trustee meeting, a modification to the Case Valuation Matrix Section V(vii) Serious Asbestosis was approved by the Trustees, with the consent of the Futures Representative and Trust Advisory Committee. The modification is as follows:

 “Serious Asbestosis” is

1.  Asbestosis with ILO 2/2 or greater and AMA Class IV Impairment

Or

2.  Where the Injured Person is “On Oxygen” and otherwise meets the requirements of subsections i, ii, or iii, below.

      i.  Injured Person has a diagnosis of asbestosis, has pulmonary function test results qualifying as Grade I, and a Pulmonologist or Occupational Medicine physician states that a contributing cause for the use of oxygen is asbestosis. Claim will be valued as a matrix claim even if there are other contributing causes listed for the need for oxygen.

      ii.  Injured Person has a diagnosis of asbestosis, but does not have pulmonary function test results qualifying as Grade I.  Even though a Pulmonologist or Occupational Medicine physician states that the predominant cause or contributing cause for use of oxygen is asbestosis, claim a) will be valued under Individual Review and subject to the Individual Review process as described in Section VIII of the Matrix and b) if there are other contributing causes, the Trust will give equal weight to each cause for the need to be on oxygen.

      iii.  Injured Person has diagnosis of asbestosis, treating physician board certified in pulmonology or occupational medicine prescribes oxygen to the Injured Party, and the treating physician states the predominant need for oxygen is asbestosis.  Regardless of the existence of other contributing causes for the need to be on oxygen, claim will be valued as a matrix claim.

“On Oxygen” means oxygen needed to perform activities of daily life, e.g., not oxygen that is prescribed only for comfort care, at night, for surgery, or on occasion.

Or

3.  "Asbestosis death" is where asbestosis is listed as the cause or a significant contributing cause of death on the death certificate, or where a report from a Pathologist, Pulmonologist, or an Occupational Medicine Physician states that asbestos was a significant contributing cause of death.  If an Injured Person has evidence of serious asbestosis or asbestosis death, and exposure to (debtor) products or conduct was a substantial contributing cause of the serious asbestosis death, then the valuation criteria for lung cancer, including the base Lung Cancer case, as defined in (II)(a), shall be utilized to determine the value of the claim.

The Plant Asbestos Settlement Trust is in the process of identifying Pre-Petition Trust Claims to be processed and paid pursuant to Section 5.5 of the Trust Distribution Procedures.  Claims that were liquidated by a settlement agreement or judgment entered into on or before May 20, 2009, should be submitted to the Trust no later than June 8, 2015 for review.   Processing of Pre-Petition Trust Claims submitted without proper documentation will be significantly delayed.  As well, processing of Pre-Petition Trust Claims submitted after June 8, 2015 will be significantly delayed. 
 
The Trust will require all documentation demonstrating the validity of the settlement or judgment, together with evidence of prior amounts received and/or amounts remaining unpaid.  Submissions may be sent by e-mail to  gate io, or by electronic media, or in paper form to Laura Paul, Plant Asbestos Settlement Trust, 300 East Second Street, Suite 1410, Reno, NV  89501.

As you may have been previously notified, the Trusts have been working to develop a new claim processing system which will allow for Web based claim submissions. The new web based system is nearing its first completion date where the Trusts can begin accepting new claims and resubmission of current pending claims.  The Trusts wanted to notify all filers of some important upcoming dates. If these dates change dramatically, you will be notified and the new dates will be posted on each Trust’s Web site.

Important Dates

June 22, 2015 is the last day the Trusts will be able to process claim offers, releases and payments in the current claim processing system. Please send all signed releases to each of the Trusts before this date. If, for some reason, releases are not received by this date, the releases will be processed in the new system which will mean an approximate six week delay.

June 26, 2015 is the last day you may submit new claims or resubmit claims through the existing site to the existing system. At 5:00 p.m. Pacific Daylight Savings Time on Friday, the Trusts will close access to the existing claim processing system for all submitting firms. However, if you have a claim that has a potential statute of limitations issue, please submit your claim to the appropriate Trust in  paper format to the following address:

June 29, 2015 Prior to this date, the Trusts will send out firm reports which will include the status of all the claims submitted by your firm. Once you receive the reports, we ask that you immediately compare your firm report to your database and let us know if any claim is not accounted for within the report you receive. 

July 13, 2015 the Trust staff will begin data entry on the Trust side of the new system.  If your firm has not previously worked with and/or filed claims with a Web based system and  is interested in training, please let us know. Once we begin to accept claims we will set up go-to-meetings for individual firm training.

July 20, 2015 is the day the Trusts plan to begin accepting new claims and resubmissions of pending claims in the new system.

August 2015 the Trusts are planning on making claim payments within the first few weeks of August for releases received after June 22, 2015. 

The Trusts appreciate all your patience and assistance as we change our filing system.  We believe and hope that the changes will allow each firm to view its claims online, as well as run reports concerning claims.

On April 16, 2015, the Trustees, with the consent of the Futures Representative and the Trust Advisory Committee, approved a Preliminary Plant Asbestos Site List to assist claimants in meeting their burden of establishing or characterizing exposure to Plant Products under the terms of the Case Valuation Matrix. (Matrix Section VII (b)) The list has been posted on the Claims Packet Page. The claimant continues to be responsible to present information describing the circumstances of adequate exposure at a site identified on the list and the Trust will continue to consider all appropriate evidence of exposure. (Matrix VII (a)). The Trustees expect that the list will continue to evolve as more information becomes available in the course of processing and liquidating claims. ("The Trust with consent of the TAC and Futures Representative may modify the list in light of additional evidence or experience with claims processing." Matrix VII (b)) Notwithstanding the rating assigned a site on the list, claimants may continue to "... submit additional evidence ... in support of a higher exposure categorization in a particular case."

The following notification was sent on this date to firms which submit, and may in the future submit, claims to the Trust. On behalf of the Western Asbestos Settlement Trust, J.T. Thorpe Settlement Trust, Thorpe Insulation Settlement Trust, and the Plant Asbestos Settlement Trust (collectively “Trusts”), we are writing to all attorneys and firms who regularly submit, and may in the future submit, claims to these Trusts to request your cooperation with the Trusts’ ongoing effort to insure that only reliable evidence is provided in support of claims. As you likely know from the Trusts' websites, issues in litigation concerning Michael J. Mandelbrot and the Mandelbrot Law Firm were reduced to judgment in 2014. (See the attached copies of the Judgment and some of the related documents.) In discharging Trust responsibilities to scrutinize all evidence for reliability, and in light of recent information that Mr. Mandelbrot has continued to be actively involved, we are asking that your firm confirm to the Trust that the evidence you are submitting is in compliance with the Court Order, and especially to inform the Trust if and, if so, where Mr. Mandelbrot has been involved in preparation of evidence submitted under oath or affirmation in support of claims. The Trust is completing work on a new Web-based claim processing system that likely will be up and running in late spring. The Trust also is working to identify possible Plant Asbestos Settlement Trust sites, create a preliminary site list, and to establish the Funds Received Ratio. None of these have been completed at this time, but work is continuing. In the meantime, the Plant Trust pursuant to the Trust Distribution Procedures and Case Valuation Matrix will start accepting paper format claims. At this time, all claims must be submitted on paper by mail to the Plant Trust at 300 East Second Street, Suite 1410, Reno, Nevada 89501. Claims that are submitted on a CD or other storage media will not be accepted and will be returned to the sender. The paper claim form is located on the Trust’s Website www.pastrust.com under the “Claims” tab. In addition to the claim form, claimants will need to submit the required supporting documents, also in paper format, and to bookmark and highlight the information relied upon within the supporting documents. (One way to bookmark and highlight the paper claims is to circle the information on the specific page and then place a marker or sticky tab on the relevant page. This will allow the Trust to locate the pertinent information in an efficient manner). The Trust does not yet have an approved site list. Therefore, each claim must include reliable exposure evidence, including documents bookmarked and highlighted, supporting qualifying exposure at a site or sites. Failure to submit site back up documents will cause claim processing delays or rejection. The Trust will date and time stamp claim submissions as they are received and will create a master file for each claim. In addition to your claim submission, please include your $250.00 filing fee for each claim submitted. When the Trust’s Web-based claims processing system is operational, the Plant Trust will reduce all paper submissions to an electronic format and input them into the new Web-based claim processing system in the order they were received. The Trust does not anticipate paying any Plant Trust claims until after the new Web-based claim processing system is in place. However, the Trust will immediately begin to process paper claims, endeavor to resolve any claims issues and prepare claims for offers to be made as early as is feasible after the new system is in place.

The Trust has entered into a settlement approved by the Bankruptcy Court with certain insurers for Plant related to Resolute Management and its affiliates.  The settlement is subject to reconsideration procedures as detailed in the Notice of Entry of Order and of Reconsideration Procedures.  The documents submitted in support of the motion are the Plan Proponents’ Motion for Order Approving Settlement..., and the Declarations of Steven Sacks, Stephen Snyder, Thomas Ryan and Alan Brayton.  The period for reconsideration of the Motion expires on September 19, 2014.
